Former IT Official Surrendered to FBI, Allegedly Leaked Mayor's Office E-Mails

According to a complaint provided by the U.S. Attorney's office.

 

Former IT official Patrick Ricciardi, who was responsible for managing the IT department in City Hall, surrendered to FBI agents on Wednesday morning and will be facing charges of leaking confidential information and intercepting communications that were meant for Mayor Dawn Zimmer, according to a complaint provided to Patch by the U.S. Attorney's office. 

Ricciardi, 45, is charged in a federal criminal complaint with one count each of accessing a computer without authorization, interception of wire and electronic communications, and disclosure of intercepted wire and electronic communications. Ricciardi wass scheduled to appear this Wednesday afternoon before U.S. Magistrate Judge Cathy L. Waldor in Newark federal court.

Ricciardi "intentionally accessed a computer without authorization and exceeded authorized access, and thereby obtained information from a protected computer, namely the servers of the City of Hoboken," the complaint states.

According to the complaint, Ricciardi confessed to law enforcement officials in May that he had set up an "Archive File" from which he forwarded information to others. According to the complaint, he had set up the archive file, "so that it would automatically forward all e-mails sent to the Mayor and two high-ranking Mayor's Office Employees to the Archive File."

The issue first came to light "on or about May 16, 2011, (when) the Mayor's office hired a private company to perform a security audit ... on the computers located within the Mayor's office," according to the complaint. The audit showed that "the Archive File contained copies of e-mails that had been sent to the Mayor's e-mail account and to the e-mail accounts of certain Mayor's Office Employees," according to the complaint.

The law enforcement officials have confirmed that the "archive file" was on Ricciardi's computer, according to the complaint.

The information was sent to at least two different email accounts, according to the complaint. The recepients of the information were not named in the complaint, but it involves one former and one current municipal employee. On May 18, one municipal employee provided the mayor a hard copy of an email received from Ricciardi's personal email address, according to the complaint. The emails in question were a conversation between the mayor and high ranking officials.

FBI officers visited City Hall in May and executed a search warrant, taking computers and servers with them, according to the complaint.

According to the complaint, the mayor and other municipal employees were not aware of Ricciardi's actions.

Have any political-operative efforts perpetrated by this Lane Bajardi fellow have led to any FBI interest in him and/or Elizabeth Mason? Has Mr. Bajardi been interviewed by any FBI agents? Have his activities been the subject of any FBI interviews? Is it true that Mr. Bajardi and his wife Kim sought to parlay their support for Elizabeth Mason and Peter Cammarano into City Hall employment? Have either of them collected any monetary compensation for any of their political-operative efforts?

The charge has to include info about who the emails were leaked to. My guess is that Claire has declined to print this info, though she has it, so she can include the response of those people in her story. Of course, this will simply result in allowing other media outlets to "scoop" her.

GA, I hate to do this...but I think that is wrong to post on MANY LEVELS!

1. Standard prison issue is vertical not horizontal stripes.
2. Except in a few strange areas, they usually wear orange now.

Of course, I'm not sure of either of these as I've never been to prison, but I'm sure one of our fave bloggers can fill us in on this in time.

My guess is a current and a former member of the CC are individuals #1 & #2.. Take your pick which ones you believe were involved.

BTW - it also seems as if the emails could have been manually forwarded to others beyond individuals #1, #2 & #3. I did see mention of "several email accounts". That suggests more than 3. The complaint also says "at least 2 accounts" suggesting other email accounts could have been receiving the hacked emails. Should be fun to see who is in hot water w/ LE!

Patrick was earning $200K, had a cheap apartment in Applied, and recently purchased a condo at Metrostop at half price, courtesy of the city's "workforce housing" agreement with the developer. Point is, this guy had it good, but that wasn't enough. The Hoboken Syndicate wants back in. As Castellano says, what a shame.

It certainly seems like a lovely day for a stroll through Hoboken's parks. I recall outofcontrol earlier stated she was making the trip to Hoboken to enjoy our parks. Contrary to the moronic musings of certain Zimmer-worshiping online minions, the FBI couldn’t care less about who releases public documents to members of the credentialed media. The press has a legal right and responsibility to inform the public about the government’s operations. Anybody who says otherwise isn’t familiar with The Pentagon Papers.

The FBI doesn’t care that Zimmer and her henchmen have issued a “Gag Order” to city employees, or whether someone may have violated Zimmer’s Big Brother communications policy. It’s more likely that a far stronger parallel rumor is true – that Zimmer brought in private Information Technology experts to scour the city’s hard drives for evidence employees were whistle blowing to the media. As the rumor goes, this IT crew is purportedly somehow connected to (or recommended by) the New York political campaign team that ran Zimmer’s council elections.

Rumors and theories as to how and why the Federal Bureau of Investigation might have found itself rummaging through Hoboken hard drives have been fast and furious. The latest development involves word of a return trip by investigators who came back to City Hall with a subpoena for the hard drive of a computer in the City Clerk’s office. There is also word that taxpayer-paid Mayoral Spokesman Juan Melli is now referring reporter inquiries to his personal attorney. The focus for some remains on the question of whether the Zimmer Administration aided and abetted the destruction of public documents on city computers to avoid an embarrassing investigation, while others say the inquiry may also involve questionable procedures for the awarding of public contracts.

So much for Mayor Dawn Zimmer’s efforts to hide the emails of political aides Juan Melli and Dan Bryan. Zimmer and her taxpayer-paid lawyers have been claiming the release of the emails (which are public documents) would “compromise the ongoing investigation by the FBI.”

Council President Beth Mason contacted the FBI agents on the case who had a different view than Zimmer’s party line. Turns out the Feds have no interest in being used by Zimmer as a political weapon to protect Melli and Bryan.

Much ado, much ado. C'mon people, settle down. I've worked in IT for years. This kind of thing happens all the time. You accidentally create a filter that captures specific internal emails and routes them out to separate external accounts. What, you've never done that before?

I'm sure this is just a case of fat-fingering. Probably didn't even know it was happening. Nothing to see here, move along. No wonder 411 isn't reporting it.

Sounds like standard procedure for simple programming mishap.. Fat boy was shackled like an Al Queda prisoner in Gitmo. Clearly they're just bringing him in to ask a few questions and get some details straight. Good call.

By keeping Ricciardi, lone wolf, unaligned to anyone, strictly acting on his own IT guy in chains, they keep him from inadvertently writing any other bad code. And it's a warning to all other lone wolf, not part of any conspiracy of any kind IT guys to double-check their code to make sure they aren't accidentally filtering emails and sending them to external nodes.

Here is Mason's statement:
"As you may be aware, the US Attorney’s Office announced that Hoboken’s former IT Official surrendered to FBI Agents after admitting to intercepting and leaking City information.
"Also, included in the indictment are three unidentified individuals who are simply described as (1) a City municipal official, (2) a former City municipal official, and (3) a City municipal employee. The names of these individuals should be released immediately. The people of Hoboken have a right to know how their trust was violated.

Unbelievable! If anyone holding public office or otherwise employed by the City of Hoboken sought receipt of these emails, they should step down from their position immediately. This is unacceptable, particularly in a city that has weathered the criminal scandals ours has over the past decade.

Individuals #1, #2, perhaps #3 depending on the circumstances and every other person who ever saw these emails or knew about the leaks and said nothing as soon as they found out need to leave city employment and city politics for good. I'll have to ask my colleagues Mr. Outofcontrol, because I haven't attended a professional football game since the Giants lost to the Patriots during the 2008 regular season. I do know that someone has tried to insinuate that I attended a football game with Frank Raia on certain online forums. If that was you, please identify your true self so that I can have an attorney contact you about a libel lawsuit. I haven't attended a football game in years.

Also, please don't try to deflect attention away from people being taken in hand and ankle cuffs into the custody of federal officials. This email communications breach is beyond pathetic, and anyone City official involved in it should step down immediately.

If any current City officials are involved in this email mess, they should resign immediately.Obviously "individual 1" and "individual 2" know who they are and if one of them is currently employed by the city, either in an elected or appointed position, he or she should step down immediately.

Wow this is turning into a bad version of mission impossible. I remember patrick way back when he used to work at flash tech and helped me with my computers. Was always the nicest guy, I would've never guessed he was living large. This is a shame. Hoboken is quickly becoming an embarrassing place to admit one lives in.

Ricciardi lived in one of the half priced units in Metrostop? Didn't Mason and Russo vote for that workforce housing about a year or two ago? Makes you wonder why a guy who could easily afford one of those apartments at full price would need to be provided with a heavily discounted unit. Almost like a bribe but without having to hand over cash.

As much as I'd like to have another thing to blame on Russo and Mason this one might be a stretch. They might have voted for the discount housing to move forward, someone else...and not the council...had to approve the specific applications. Is it possible they made a couple of phone calls on his behalf? Sure, but would be a tough one to prove. I think the key thing is to wait and see who was receiving the eMails from this jack--- and then see if they provided any incentive to have him send them and what they did upon receiving. Don't worry. That info will come out soon enough and everyone involved will be singing to the feds once they're brought in. these are the fox hole types at all. They are all save themselves types regardless of who they have to throw under the bus. Heck, Russo threw his old man under the bus when he was going after a council seat.

Patrick Ricciardi is not "victim" he has been involved in many illegal activities in the workplace in his past. Primarily theft, fraud, etc. It's the first time he has gotten caught. He even did something illegal for Anthony Ricciardi, who is City Hall employee! There has been a bench warrant for him in NYC from JF Larzartique on Madison Avenue NYC. Employers need to do their research before hiring someone!!

I wasn't a fan of the housing discount from the start, after all, a job with the city doesn't mean that it's for life (at least it shouldn't be). I was kind of OK with it, thinking it would be someone making a moderate income with a family perhaps, but NOT some guy making 200k! Jeez, what the hell is that about? He doesn't even need the discount, you can easily afford a nice apartment in Hoboken on that kind of salary!! Something is fishy there, and when you consider when it happened and how long he was likely collecting Zimmer's emails, it all adds up as far as I am concerned.

Adds up to what? I'm not being sarcastic but am genuinely interested in your views on what this might indicate. There's little doubt that this town needs a major clean out if its ever going to meet its potential. The town needs to clean out all of the nepotism (the Russos, the Castellanos, etc.) as it not only drains the town of tax dollars which could go to bettering the town or helping the less fortunate but it also keeps out competent people that could bring a great deal of talent and capability to the town that people like Russo, Mason, Ochi and certainly Castellano simply don't have. The departments which are dumping grounds for connected town's people need to be cleaned out. Again, just a tragic waste and drain of tax dollars. Even the police and fire departments need a cleaning. I'm not necessarily saying there should be fewer police and fire, but clearly for the salaries the taxpayers are paying the town should be getting far better qualified people in these departments. The board of ed, the housing, etc. are filled with connected family members which are costing the city hundreds of thousands if not millions. And can someone please grow a pair and get a collection agency on Russo's dad so he pays up his six figure debt that he owes the city. Or at least put a lien on his NJ shore house so we know the money will eventually be there. C'mon, Hoboken is a serious city and needs serious people running it and its departments.
