Mayor, Councilman File Voting Rights Law Suit
Mayor Dawn Zimmer and Councilman David Mello would like to see the Fourth Ward divided into more voting districts.

Mayor Dawn Zimmer, together with Councilman David Mello, has filed a law suit to divide the Fourth Ward—the southwestern part of town where she also lives—into more voting districts.
Zimmer is asking Hudson County to reduce the size of district 4-2. The district has about 2,500 registered voters, one of the largest districts in town.
On Wednesday night, Mello said that long lines during peak hours on election days are the reason for the law suit.
Residents Keith Furman and his wife Sandra Reinardy are also named as plaintiffs on the law suit, according to the complaint.
"I've experienced it first hand," said Mello, who is also a resident of the Fourth Ward. Mello added that he would like to see the district divided into two or even three districts as well as a polling place in the Sky Club.
Currently, voting for the district takes place at the Hoboken Housing Authority complex at 221 Jackson St.
Zimmer, in a phone interview on Thursday afternoon, said the timing of the law suit "is very tight." Re-districting has to occur at least 75 days before the June primary, which means the change will have to be implemented—and the law suit completed—by March.
Districts are required to be subdivided if more than 750 people cast votes in consecutive years. "This is the one district where numbers are way over," Zimmer said. Zimmer said that all districts should be around 750 people. While other districts in town are also more than that, 4-2 is the only district where the state is required to make a change because of turn out in previous years.
Redistricting for the rest of the city can wait until after the presidential election, Zimmer said.
The other districts in the Fourth Ward—the ward is made up of four districts—have between 1,200 and 1,500 registered voters. "They're all quite large," Zimmer said.
Mostly, Mello continued, the move is supposed to help voter apathy and encourage more people to vote.
"Not only are 4-2 residents crammed into an election district more than 3 times larger than normal, they do not even have a polling place within their district," Zimmer said in a press release on Wednesday night.
During the 2008 presidential election 1,400 residents in 4-2 cast their votes, Zimmer said. The mayor and Mello said they hope the new districts will be in place before the 2012 presidential election. Both Mello and Zimmer are up for re-electoin in November 2013.

I guess I shouldn't be surprised that Hoboken Questioner has no issue with the polling stations that are located in the Church Tower lobbies, Marine View Towers, senior buildings and the HHA. So... why not the Sky Club lobby in the 4th Ward or the lobby of 800 Madison in the 3rd Ward?

Councilman Mello's idea for polling stations in the SkyClub or other large residential buildings is an excellent idea to increase voter turnout. Perhaps that could be considered in other wards too. The 3rd Ward that has several massive apartment complexes that occupy full city blocks.

Good point CuriousGal - here we go with another lawsuit. The HQ is all for increasing voter participation but do we need to take people to court to do this? I don't get it.
Also Vote by Mail is the wave of the future. NJ ELEC encourages this voting method. Zimmer and her crew are against it because the overwhelming majority of VBM's are anti Zimmer.

Perhaps splitting up a ward (or two) could help offset Hoboken's purchased votes somewhat. It's sad that election after election obviously has a bought and paid for vote component. We residents never actually know the true the will of the people. (I, for one, don't trust the machines here either.) If the county (or state) won't step up and do something about what clearly goes on during our elections, I applaud Zimmer and Mello for taking whatever steps they can to help alleviate any election problem including an over sized ward/district.

CuriousGal, I like to think of recent statements by the SEC on insider trading when it comes to Hoboken corruption--If you haven't been arrested, it's not a sign you haven't been caught. If you haven't been arrested it's a sign you haven't been caught YET.
As for the argument that there already is a way around this, this is NOT a solution to voter disenfranchisement, until all the polling places are taken down, including the one in church towers. Of course, you already knew that...that's why you have some silly argument against the goal of increasing voter turnout...just like when elections were moved to November.

Regarding invasion of privacy of former City employees, the mayor is not the legal entity to investigate but if you have information please send it to smartyones@me.com as none appears available and the alleged injured party in question has dropped the matter.
If someone violated a former city employee's privacy, that's 100% wrong. Comparison to the full scale ransacking of communications inside the mayor's office going back to 2010 may be equally so.
A limited list of suspects have already been partially identified by the FBI and there's more to come. That's the subject of MSV Premium Content and will be released in short order.

Hoboken following state election law? Don't be silly.
I've been complaining about the challengers at my polling station for years. They are clearly violating the law (as are the poll workers). I have called the county to complain. I have printed out a copy of the law and guidelines and handed them to the challengers and poll workers...and yet the same "illegal" BS goes on at every election.
1) Challenges cannot sit with poll workers or touch election materials. I guess having the challenger table pushed up against the poll worker table doesn't count.
2) Challengers cannot challenge the voter directly, only poll workers can ask the voter questions.
3) Challengers cannot challenge a voter because a poll workers asks the voter to confirm their address.

I did not see any corruption, just a deposition/testimony being conducted by an amateurish attorney. What does this have to do with the firing, anyway? It seems like an attempt to get Bet's spin out on the emails. If that attorney was provided illegally obtained emails, then the whole case is going to blow up in her face. I have heard very recently that there are some unexpected shoes about to drop that will surprise a bunch of folks.

You do realize that b/c it was set up as a PAC, there are laws that make it illegal for candidates to coordinate w/ the PAC so the mayor and other candidates were deliberately kept out of the loop from what the PAC was doing. That is how the law was written and it is my understanding that is how things were operated. As for who was behind the PAC, there were hundreds of people who donated their time, their money, the use of their homes and their energy to that PAC. The list of names is too long to be named. I am sure a few of them show up on the ELEC filings but only a gadfly like you would bother to look it up.
As for the laid off workers who you are shilling for, they were laid off for a reason. Their jobs are gone. The people who you claim are replacing them as I understand it have job responsibilities that go far beyond what the people they replaced used to do. Those people weren't replaced, it is my understanding that their jobs just disappeared.
Last point - nobody cares that the deposition is public information. What bothers us is Mason continues to spend money on trying to tear down her opponents and make this town look bad. Perhaps things like that don't matter to you, but they matter those of us who care about honesty, integrity and clean government. She is a vile and disgusting woman and her conduct is completely unacceptable.

LtTruthseeker - thank you for your insightful comments. I hope there is more investigation into this PAC. If the law was broken then people need to be held accountable. My two cents is that Zimmer is really not bright enough to do some of this kind of stuff. So probably in her mind she is innocent. But in reality I think she has gotten into some dirty stuff. I think most people would agree with that.

Here is my take.
Until the state abolishes voting at a polling place and forces everyone to vote by mail, the rules that dictate how polling places and wards/districts operate must be followed.
650 people above the 750 max voted in 2008. Machine or mail in votes in the long run does not matter because there needs to be adequate resources allocated to process the votes by mail. The district needs to be redrawn.
I do not vote by mail because mailed ballots are not always counted. The are only counted if there are enough mailed ballots to possibly change the outcome of the election. I would vote by mail if they changed the law to make sure the mailed ballots are always counted.

C.Harrison, mailed ballots are ALWAYS counted. Provisional ballots are counted too, although those are the ones that sometimes are held for a day or two because they require more research (making sure voter is registered, for instance). All ballots are counted before an election is certified by the County or City Clerk.

Curious - I apologize - your litigious point was buried among the mountain of non-sequitors.
Can you provide a list of lawsuits Z & M have been involved in and identify which one's you disagree with and view as examples of over-litigiousness? I know of only two - the lawsuit that blocked a redevelopment plan for the SW that was opposed by most SW residents and the current suit intended to enforce the rights of 4-2 residents under NJ law. Their won/loss record so far is 1 win and one to be decided.
Also, unless you can identify more lawsuits, please explain how you would characterize Mrs. Elizabeth Mason's litigiousness as compared to that represented by the 2 lawsuits brought by Z & M? What is her won/loss record and what have her lawsuits actually accomplished? Has she released the records she sued to get to the public?
I really am going to miss this! I know the best thing for me will be to go cold turkey and just move on into my new life but I don't know if I'll be able to.

1- before this administration and boe majority there was NO LINE ITEM for legal costs- NONE. In one case alone during the ole days, there was a 600k payout/loss for the boe-We are still paying for that one. Was that found anywhere on a legal cost line in prior budgets before this administration? NO- because there was no legal cost line.
2- 2 of your supporters filed bogus costly lawsuits costing the district $$$$$$ to fight in court. So much so, it blew the legal budget through the roof. They both lost but the hboe had to pay to defend the case in court. Then, somehow another one of their buddies filed another bogus claim that must be defended in court- no doubt that one will some out with the same results as the prior bogus complaints. Sounds familiar, doesn't it?
3-How about that workmans compensation-probably costing $$$$ for one of your political operatives "cause he can't stand for long periods of time." Yet, he can assault a young mom of 3 ,on the street, during political season.
Here's a suggestion,Why don't you guys stop with the bogus lawsuits so legal costs can go down?
My guess is that would be a solid NO- cause then you can complain about legal costs.

I would like to know why 4th Ward councilman Tim Occhipinti has NOTHING TO SAY about this lawsuit which will benefit HIS constituents. Why hasn't he joined the suit? Does he support it? Is he gun-shy now because of his (latest) geography mishap and afraid to comment - just in case the 4-2 turns out to be part of Jersey City?

In fact, "suspicion" has been the root justification for numerous official and unofficial governmental atrocities. So I read the article. It makes a vague mention of some posting online. It says nothing about a ss# or any details whatsoever. How can anyone really know where it came from in the first place? To be honest this is not an issue, not even a little. The alternative to the Mayor in Hoboken are the same yahoos that ran it into the ground over the past few decades. Now that Mason votes with the minority on the council, she's untrustworthy. Her unprofessional behavior, lack of due diligence, anger management issues, and her voting record make her unacceptable as a representative for this city, county or state. I find it funny that so many here want to accuse the Mayor of being too litigious when her current allies on the council accused her of the very same thing for years.

Hoboken was not "run into the ground over the past decades" but rather experienced an incredible urban renewal. Characterizing the past as "run into the ground" tries to set up a situation of low expectations and "look what we were left with" excuses that hold little credence with anyone who knows what transformation has taken place in Hoboken over the past few decades.
A similar strategy is being utilized by some of these same bloggers concerning the Hoboken Public School District under the leadership of Mayor Zimmer and her fully financed and politically endorsed and supported KIDS FIRST political group. Interim Superintendent Peter Carter said, “We are taking steps to correct each and every one of [the findings] on a daily basis.”

Maybe NJ.COM is tired of character assassinations, smear jobs, lies, distortions, references to hate blog sites, etc. Also - it is not censorship if a private entity does it. A private entity has every right to try to protect itself from defamation suits; thus, if a commentator keeps bashing someone then it is perfectly logical that the private entity may ban that commentator.

Why is Tim Occhipinti defending the County Machine's attack on voter rights? The Machine has been breaking the law for over 2 years now, how long does Tim think the people of the 4th Ward should wait to have the County stop breaking the law?

Wouldn't "the timeline that Mayor Zimmer wants" be the same timeline Tim wants? In time for the 2012 presidential election; preferably at least something temporary in place in time for the NJ primary? How is this unique to the mayor & Mello and not shared by Occhipinti?
Curiouskim says "lead, don't litigate." So how is the man for whom her husband wrote all those nifty debate answers "leading"? By waiting until the county gets around to it? That's leading?

.' there are only two cover stories in the HR, not sure why you had such difficulty finding it and then when you found it you had to actually overlook most of it purposely! i agree that mason is an issue but if someone inside city hall took an employees confidential personnel info and posted it on line it would be a concern too for any reasonable thinking person, so why dont you care at all? even a little? it is possible to care about this and still attack mason you know. rather then seeing everything as it has to be about mason why not raise the question of how this may have happened in town hall and what can be done? for every six posts against mason maybe someone here can broach this topic without feeling the need to add a little addition like 'at least it's not as bad as what mason did?' even horse acknowledges this is a bad thing to happen but then comes up with reasons not to care. the person who leaked confidential information may still work there, may still be doing it. don't you care? or is anything going to be swept under the rug if its not a mason v zimmer issue?

Sure, that's not a cool thing to do, and I want to see the posting itself, this article is very vague on details. What website was it posted on, would be my first question. second would be from what IP address did the message originate from, which should be available to anyone running that site.

The Zimmer administration proper does not have a rep for leaking protected info. That honor goes to Riccardi and the Old Guard still in City Hall.

Sincerely the Zimmer admin could have been leaking damaging info on any and all of the people suing them, most I believe frivolously but that's beside the point. Leakers seldom if ever leak once so you have to ask yourself who knew and wanted to either hurt the Mayor, the City, or the plaintiff.
